b. Service providers acting on our behalf. We use vendors to run our practice — for example, website hosting, electronic health records, scheduling, telehealth, payment processing, and our telephone and messaging provider. These vendors process information solely at our direction, are bound by written contracts (including HIPAA Business Associate Agreements where required), and are prohibited from using your information for their own purposes, including any marketing purpose of their own.

c. Your health plan and payers. With your authorization or as permitted by HIPAA, we share information necessary for treatment, payment, and health care operations. This is described in our Notice of Privacy Practices.

d. Legal and safety. We disclose information without notice only when required to do so by law — for example, in response to a subpoena, court order, or lawful government request — or where permitted to prevent serious and imminent harm to you or another person.

6.2 How we obtain your consent

We send text messages only to people who have given us express consent to be texted at their mobile number. Consent is never a condition of receiving care, and it is never bundled with any other agreement. You may withdraw your consent at any time.

6.3 Message frequency and cost

Messaging frequency may vary and depends on your appointments and your communication with our office. We do not charge for text messages. Message and data rates may apply based on your plan with your mobile carrier.

6.4 How to opt out

Reply STOP to any message from us at any time to be removed from our text messaging program. You will receive one confirmation message and then no further texts. Opting out of texts does not affect your care; we will simply reach you by phone or email instead. To opt back in, reply START.

Mobile carriers are not liable for delayed or undelivered messages.

Your mobile number and SMS consent record are kept for as long as you remain opted in, plus the period we are required to retain proof of consent. If you opt out, we retain only the minimum record needed to honor your opt-out.

Progressive Pathways Psychiatry, L.L.C. is a HIPAA covered entity. Your protected health information is governed by HIPAA and by our Notice of Privacy Practices. Where HIPAA gives you greater protection than this Privacy Policy, HIPAA controls.

Please do not include detailed clinical information in text messages, website forms, or ordinary email. These channels are convenient but not fully secure. Use our patient portal or call us at (469) 523-2646 for anything clinical.

If you are experiencing a medical or mental health emergency, call 911 or go to your nearest emergency room. Do not use text, email, or this website to report an emergency.

13. Children's and Minors' Privacy

We provide care to patients aged 6 and older. Where a patient is under 18, a parent or legal guardian provides all consents on the patient's behalf, including consent to receive text messages, and we correspond with the parent or legal guardian.

We do not knowingly collect personal information online from children under 13 without verifiable parental consent. If you believe a child has provided us information without their parent's or guardian's consent, contact us and we will delete it.
